Terms and Conditions

All sales made by Ladybird Cakes are subject to the following terms and conditions.  This does not affect your statutory rights as a customer.  Please read through the following terms and conditions; if there is anything that you do not understand then please do not hesitate to contact us. 

Price
The price for the order shall be stated on your order form, a copy of which, you will be asked to read through, check and sign before returning it to us.  By paying a deposit and signing the form, you agree to pay the full price to Ladybird Cakes in accordance with the details on the order form that you will have checked and agreed.

Deposits
All cake orders require a deposit of 50% of the total cost of the cake and should be paid once the order has been checked and agreed by you. This will then be deemed as a confirmation of the order.  All deposits are non-refundable and non-transferable.

Payments
Final payments for wedding cake orders must be made at least 2 weeks prior to the wedding.  For all other cakes, the final payment must be made on delivery/collection.

Alterations to orders
Ladybird Cakes takes great pride in finishing every cake to the requirements set in your order form.  Please take time to read through this carefully and check that the details of your cake are as you wish them to be.  If you require us to make any changes to your cake, please notify us via email within 7 days.  It is your responsibility to notify Ladybird Cakes of any alterations to the original order.  Ladybird Cakes reserves the right to increase the quoted fee in the event that the customer requests a variation to the work agreed.  Please note that whilst Ladybird Cakes prides itself on working closely with every one of its customers, late changes cannot always be guaranteed.

Cake component parts
Many of Ladybird Cakes’ celebration and wedding cake designs often incorporate non-edible component parts such as ribbon, wire, beads, dowel, flower picks and lollipop sticks to name a few.  These will be specified on your delivery note which you will be asked to sign before you take delivery of the cake.  Please note that once you have been made aware of these, it is your responsibility to remove all non-edible parts from the cake before it is served and eaten.

Edible photographs
Ladybird Cakes uses a reputable company to reproduce photographic images onto icing which can then be added to your cake.  Please note that Ladybird Cakes is unable to accept orders for these if they have copyright issues, such as logos, copies of photographs without the permission of the photographer or images taken from books etc. 
Please note that the picture reproduced on to the icing sheet will not be quite as clear as the original photo.
Should you require an edible image for your cake then you will need to discuss this with Ladybird Cakes at the time of ordering and you will be asked to email the photo to Ladybird Cakes, as a JPEG image.

Collection
Your order may be collected at a pre-arranged time between Monday and Friday, 9.00am to 4.00pm.  If you wish to collect outside of these times please do not hesitate to contact us and we will do our best to help.  A signature will be required upon collection confirming that you have received your order in good condition and as specified.  You will also be required to sign a delivery note to acknowledge that there may be non-edible components on your cake.

Delivery
Your order can be delivered between 9.00am and 4.00pm Monday to Friday or 9.00am to 1.00pm Saturday unless by prior agreement between you and Ladybird Cakes.  All delivery times are subject to availability.  If you have a specific delivery date and require delivery before a given time, please specify this when placing your order.  We will do our best to accommodate your requirements.                                
It is the Customer’s responsibility to ensure that you have given us the correct delivery information, and that someone is available to receive your cake as a signature will be required for the receipt of the order upon delivery.
If the recipient is not in, the order will be returned to Ladybird Cakes who will then contact you to arrange an alternative delivery time but please be aware that you will incur an additional charge for this.
Ladybird Cakes is able to offer personal delivery within a 35 mile radius of Godalming, Surrey.  Please note that there may be a charge involved for a delivery but this will be clearly stated on your order form.      

Ladybird Cakes will make every effort to meet the delivery date set out on the Order or as otherwise agreed between us. However, occasionally delivery may be affected by factors beyond our control and, therefore, cannot be guaranteed. We will let you know if we become aware of an unexpected delay and will arrange a new delivery date with you.

Setting up
Ladybird Cakes likes to deliver and set up all tiered cakes to ensure that they are displayed at their best.  This also means that should there be any breakages or damage to the cake in transit, Ladybird Cakes can repair these on site and ensure that the finished cake is as good as new.
We will deliver and set up the cake as agreed so please ensure that you have provided us with the set-up details and arrangements made with the venue for the location and display of your cake.  This should include the display table, in the location that you have agreed with the venue, and a stand, should you require one.  Ladybird Cakes cannot be held responsible for the location of the cake at the venue.  Please ensure, therefore, that the display location is level, stable and strong enough to hold the cake.          
Please note that chocolate-covered cakes can melt in warm conditions such as inside a marquee on a hot summer’s day, or when set up in direct sunlight.  This also applies to cakes which contain fresh cream as these are unable to stand at room temperature for longer than hour.  This may mean that the cake will have to be set up at a later time in the day (pre-arranged with you at the time of ordering) or by someone other than Ladybird Cakes, at the venue.
Once the cake has been delivered, set up, and signed for, Ladybird Cakes is unable to accept liability for any interference with or damage to the cake thereafter.
If a cake is to be delivered and set up by Ladybird Cakes, a signature will be required from your venue management confirming that the cake has been received and set up in good condition.  Photographs of your cake will be taken prior to departure by Ladybird Cakes to verify that the cake has been set up and left in good condition.

Cancellations/refunds
Wedding cake or special order cancellations:
As your wedding cake and/or special order booking is reserved solely for you and certain components for your cake/s may be ordered or made months in advance, the following conditions are implemented when an order is cancelled:
6 months from delivery date – 50% of the total cost will be payable
0 to 1 month from the delivery date – 100% of the total cost will be payable.
Wedding cake/special order cancellations must be made in writing
Other cake order cancellations:
Full payment is required if cancellation is within 2 weeks of the delivery date, prior to this a refund of any monies, less deposit, will be made.

Copyright
Please note that no person shall have entitlement to copy or reproduce in any form, or otherwise make use of any image, photograph, design or other document or item produced by or on behalf of Ladybird Cakes without the prior written consent of Ladybird Cakes.

Publication and promotional rights
By signing the Order Form the Customer agrees that Ladybird Cakes is the sole designer and owner of the final cake design.  All rights in any original designs created and designed by Ladybird Cakes shall remain the exclusive property of Ladybird Cakes.  All of our designs are photographed and published on our website, our Facebook page and in our advertising material, and from time to time our designs may be published in magazines.  We reserve the right to use any image of a Customer’s cake made by Ladybird Cakes for publication after the delivery date unless previously agreed in writing between the Customer and Ladybird Cakes.
The Customer has no ownership rights over any cake design.  Exclusivity of cake designs between our Customers is not guaranteed unless the Customer commissions an exclusive design.

Allergies
Please be aware that whilst your chosen cake may not be made with nuts or a nut product, it will be prepared in a domestic kitchen where nut products are used in other cakes and fillings.  Raw materials used may not be free from dairy, wheat or gluten.  Allergy information is provided with all cake orders.

Events outside our control
Ladybird Cakes cannot be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any act, event, non-happening, omission or accident beyond our reasonable control.

Equipment Hire
Ladybird Cakes is happy to hire out a variety of cake stands which will enhance the display of your cake. Please note that Ladybird Cakes will only hire out stands that are owned by Ladybird Cakes and will not hire cake stands from a 3rd party.

Deposit
In addition to hire fees, a deposit is required for all equipment hired.
The deposit will be reimbursed in full to the Hirer, via the same payment method, upon return of hired equipment on the specified date, provided no damage has been incurred.

Equipment
All hired equipment must be returned on the specified day (unless prior alternative arrangements have been agreed) otherwise extra charges may be levied to cover further hire costs.  Collection of hired equipment may be arranged subject to availability.
Any costs to repair damage/replace hired equipment will be deducted from the deposit paid.
The equipment on hire shall remain the property of Ladybird Cakes at all times.
The Customer is responsible for checking the equipment to be hired upon receipt.  By signing the Equipment Hire Agreement, the Customer acknowledges the equipment is undamaged and in good working order.
Throughout the period of hire the Customer shall be responsible for the safe keeping of the equipment and shall be liable to Ladybird Cakes for all loss of or damage to the equipment howsoever caused.
The Customer shall pay to Ladybird Cakes the full cost of replacing any lost equipment within 28 days.  During this time the Customer is required to pay any losses incurred by Ladybird Cakes resulting from the loss of equipment hired.

Cancellation
Hire charges are refundable if cancellation is made more than 1 month prior to the Agreement date, less any expenses incurred by Ladybird Cakes, which will be specified at the time of booking equipment hire.
